On September 29th at 12:00 PM, you will learn how best to respond to proposed disciplinary actions issued pursuant to Chapter 43 (performance only) and Chapter 75 (misconduct and/or performance). Responses may be given written and/or orally and we will discuss the advantages of each, including relevant requirements under the MCBA and VA policy. We will discuss how to address all of the charges presented, review affirmative defenses, mitigating and aggravating factors ("Douglas factors"), and how to notify the deciding official of any missing or disputed facts from the evidence file. We will also discuss the timelines for the response.
